BREAKING - Marineland Files Lawsuit Against Activist


Marineland has filed a 1.5 million dollar lawsuit against an activist who just a few weeks ago was threatened by Marineland owner John Holer in an incident that was caught on video. Strangely Niagara Regional Police investigated that incident yet weren't able to find enough evidence to lay charges.

Marineland's statement of claim which was filed in St. Catharines Ontario seeks to shake down activist Mike Garrett to the tune of 1.5 million dollars plus legal fees.  The statement claims Mr. Garrett's actions of handing out leaflets to the public is unacceptable as it interferes with their business.  Their lawsuit also seeks a restraining order against Garrett blocking him access to protest near the captive animal park.  Marineland claims Garrett has conspired to engage in illegal, violent and dangerous activities and disseminating false information about the park.

Mr Garrett responded to the lawsuit via social media:

Today I was served with a Statement of Claim notifying me Marineland Canada is suing me for 1.5 million dollars and attempting to block me from demonstrating anywhere near the property.  In their claim Marineland makes numerous absurd and false allegations about myself.  My activism consists of photography and handing out Marineland Animal Defense leaflets to the public. This is an issue of public concern and Marineland will do anything to try and shut down any opposition to the park. Their Statement of Claim is frivolous and has almost nothing to do with me personally. The allegations that do relate back to me are wild and vague generalizations and also contain outright lies.
Marineland is utilizing another Strategic Lawsuit Against Public Participation (SLAPP suit) in order to intimidate and bully myself and others from exercising our freedom of expression which is guaranteed under the Canadian Charter of Rights and Freedoms.  I also believe this lawsuit has been filed in retaliation against myself only weeks after I filed a police complaint detailing Marineland owner John Holer uttering threats against me.  I will not be intimidated by Marineland's lawsuit and consider it to be utterly ridiculous and completely unfactual. Marineland has filed 6 suits in the last 8 months and all of those have been vigorously defended. No one is standing down, and I certainly will not.
Marineland is continuing their aggressive assault on anyone who dares speak up or take action against their miserable and cruel business.
